The Failure of the 28-Point Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the diplomatic emergency sparked by the announcement of a new comprehensive peace framework for achieving ceasefire appeared – temporarily – to have been defused. A senior US official spoke of "notable headway" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its countermove: an extensive attack of aerial bombardment on Kyiv.

The Rhythm of Negotiation and Warfare

The chain of opposing developments captured the bleak nature of the current period. By day, diplomatic battles are waged: optimistic declarations are issued from various governments. Significant resources is allocated on containing specific proposals. By night, the Kremlin clearly shows the world that, for them, conflict continues to be the key method for achieving "peace".

Nocturnal Warfare

As Russia's attack unfolded into the early hours of Tuesday, the current condition of Ukraine's defenselessness was laid bare. Ukraine is equipped to monitor rocket firings from Russian territory, a ability enabled by up-to-date information. From vantage locations, Ukrainian air force fighter jets that had been scrambled to counter approaching guided weapons roared overhead – sophisticated military planes provided to Ukraine by NATO members.

Shortly after, Kyiv's air-defence systems engaged: defensive missiles fired to intercept a incoming threat. This was a modern interception technology at work, presumably provided by Western nations. Every launch creates sudden vibrations, rattling buildings. The moment of terror quickly transforms into resigned acknowledgment: perhaps the hostile projectile won't hit its mark this time, sparing the city from ruin and further power outages.

Ongoing Risks

Following this, a heavy machine gun fired at a unmanned aircraft somewhere nearby, part of a rapid response unit – almost certainly imported technology. Regrettably, the shots failed to hit the enemy aircraft – it pressed on overhead toward its destination.

Periodically, this carried on until dawn. Kyiv greeted the early updates: several casualties, damage and utility failures in multiple buildings as a result of the nocturnal offensive. As typically, everyone still continued their routines – experiencing conflict. But those entire period illustrated Ukraine's essential dependence on international aid – a need that regional partners are demonstrably unable to substitute in the short term.

Ineffective Peace Efforts

The 28-point plan from American leadership generated strong feelings, discussion and serious worry – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and international summits.

Every new proposal from US leadership adheres to the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, manages to fend off. They manage the tension but never actually achieve victory. This cycle will, undoubtedly, persist.

Strategic Calculations

It is tempting to accuse particular leaders of consistently pushing Moscow's conditions. But that does not seem to be the complete picture. US administration works based on a principle understood by seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The American government believes that it is impossible to pressure the Kremlin to abandon the land that it presently holds in Ukraine's southern or eastern regions.

The issue is that while accepting these circumstances, American administration does little to prevent Kremlin actions, through diplomacy or military means, from assuming that the current condition will not change more in its favour in the months ahead.

Conflicting Perspectives

Therefore, Russian leadership is certain that the clock favors them – that Ukraine and its partners are approaching exhaustion. Their reason to accept conditions that does not give them the greatest potential benefit is close to zero. There may be many attempts to achieve ceasefire, but they will persist as long as Russia's government remains highly assured in the conclusion.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, gradually sacrificing civilians and areas but preventing a total frontline collapse until circumstances change in its advantage.

Present Conditions

Objectively, there are no actual prerequisites for a truce. Now, subjective factors are entering the equation: leadership ambitions to broker a ceasefire and obtain worldwide acknowledgment, and the government's double obstacles – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the national cause against any initiative Kyiv finds unworkable, so that their focus does not switch to homefront challenges. And although their objective will now be considerably more difficult after current events, it remains very improbable that this will modify their basic position.

These conflicting dynamics are driving the talks.

Assessment and Future

It took a just a single week to terminate the suggested clauses of the latest plan. Aggressive and erratic handling of the matter by US administration, pushback by Ukraine and the other European countries, along with pacifying measures of diplomats, and finally, current information leaks, all served their function.

While new initiatives based on previous concepts are approaching, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and show particular unwillingness to modify developments, if they maintain solidarity and improve their protective measures at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the predictable period, largely rely on sustained allied backing.
